Terms of use | Cartworth

The part that matters most. Cartworth shows you what retailers are publishing. It is a guide, not a guarantee. Stores change prices without notice, published listings go stale and can simply be wrong, and an online or delivery price is often not the shelf price. Always check the shelf tag before you buy. Do not treat anything in Cartworth as a promise of what you will pay.

This agreement

These terms are an agreement between you and Cartworth ("we", "us"), covering the Cartworth iPhone app, the free web version of Cartworth, and this website (together, "Cartworth"). By using Cartworth you accept them. If you do not accept them, do not use Cartworth.

Our handling of information is described in the privacy policy, which forms part of this agreement.

You must be old enough to enter a binding contract where you live, and if you buy a subscription you must be old enough to make a purchase from the App Store.

What Cartworth is

Cartworth is an information tool. It reads prices that retailers publish online — on their own sites where they publish one, and otherwise through the online storefront platform most chains use to publish their catalogue — together with the weekly circulars distributed on their behalf. It converts those prices to a common unit so that different package sizes can be compared, and presents the result alongside the distance to each store.

Cartworth is not a retailer, a marketplace, a delivery service, a broker or an agent. You cannot buy groceries through Cartworth, and no purchase you make at a store is a transaction with us. Cartworth does not set any retailer's prices and has no ability to influence them.

Accuracy of prices

This section is the heart of the agreement, so it is written in plain words.

Prices change without notice. A retailer can change a price between the moment it publishes it and the moment you reach the shelf. Nothing Cartworth shows you is a quote, an offer, or a price we can hold for you.
Published listings can be wrong. Retailers make mistakes in their own catalogues and circulars. Cartworth repeats what the retailer published; it cannot detect an error the retailer has not corrected.
Online prices are often not shelf prices. Where a retailer publishes only an online, delivery or pickup listing, that price can run above the in-store price, and retailers commonly say so themselves. Cartworth labels which kind of price you are looking at. Do not read an online price as a shelf price.
Weekly ad conditions apply. Multi-buy prices, BOGO offers, loyalty card prices and digital coupon prices carry conditions set by the retailer: purchase minimums, limits, date ranges, membership requirements and coupons you must clip. Cartworth surfaces those conditions where the circular states them, but the retailer's own terms govern the offer.
Unit prices can involve estimates. Where an item is sold by the piece and no weight is published, a typical weight may be used to produce a comparable unit price. Those figures are marked as estimates and should be treated as such.
Availability is not promised. Cartworth does not know whether an item is on the shelf at your store right now.
No savings are promised. We make no claim, express or implied, that using Cartworth will save you any particular amount of money, or any money at all.

Always check the shelf tag. Your decision to buy is yours, made in the store, on the basis of the price the store is actually charging.

The free website and the free tier

The web version of Cartworth at this domain is free to use and requires no account. The iPhone app can be downloaded and used without paying: the free tier includes three searches per day, one price watch, this week's weekly ads, store discovery and your shopping list.

Free means free. We are not obliged to keep any particular free feature available forever, and we may change what the free tier includes, but we will not quietly start charging for something you have already paid for.

Cartworth Pro: plans and prices

Cartworth Pro unlocks unlimited searches, unlimited price watches, price and sale alerts, favorite brand alerts, recipe import, trip planning, price history, and next week's ads as soon as stores post them. All three options below unlock exactly the same features.

Pro monthly: $3.99 per month. Auto-renewing subscription.
Pro yearly: $19.99 per year. Auto-renewing subscription.
Pro lifetime: $29.99, charged once. Not a subscription and it does not renew.

Prices are in US dollars and are the prices on the US App Store. In other countries the App Store sets the local price, which may differ after tax and currency conversion. All three products are enabled for Family Sharing. There is no free trial and no introductory offer at this time; if one is ever offered, its terms will be shown on the purchase screen before you buy.

All purchases are made through Apple's In-App Purchase. We do not sell Cartworth Pro anywhere else, and no purchase made outside the App Store unlocks anything in the app.

Auto-renewal, cancellation and refunds

The monthly and yearly plans are auto-renewing subscriptions. In plain terms:

Payment is charged to your Apple Account when you confirm the purchase.
The subscription renews automatically at the same price for the same period unless you cancel it at least 24 hours before the end of the current period.
Your Apple Account is charged for the renewal within the 24 hours before the current period ends.
You can manage your subscription and turn off auto-renewal at any time in your Apple Account settings on your device. Cancelling stops the next renewal; it does not end the period you have already paid for, and you keep Pro until that period runs out.
Switching between monthly and yearly is handled by the App Store. Moving to the higher tier takes effect immediately and Apple prorates the change; moving down takes effect at the next renewal date.
If we ever change the price of a subscription, Apple will notify you and ask for your consent before the new price applies to your renewal, in line with App Store rules. You can cancel instead.

Refunds. Purchases go through Apple, so refunds are handled by Apple and not by us. Request one at reportaproblem.apple.com. We cannot issue, reverse or guarantee a refund on Apple's behalf. Where the law where you live gives you a statutory right of withdrawal or refund, that right is unaffected by this paragraph.

The lifetime option

Pro lifetime is a one-time purchase of a non-consumable product, not a subscription. Nothing renews, nothing is billed again, and there is nothing to cancel. It unlocks the Pro features in the Cartworth iPhone app for the Apple Account that bought it, and it can be restored on your other devices and shared through Family Sharing.

"Lifetime" means the lifetime of the Cartworth iPhone app, for as long as we publish it and it runs on supported versions of iOS. It is not a promise that the app will exist forever, that any particular retailer will keep publishing prices we can read, or that a specific feature will never change. If Cartworth is ever discontinued, we will say so publicly and in good time rather than letting it quietly stop working.

Retailers and third-party content

Cartworth is independent. It is not affiliated with, endorsed by, sponsored by, partnered with or approved by any retailer. Retailer names appear only as plain text, to identify which store published a given price, which is a factual, nominative use. All retailer names, trademarks and other brand features belong to their respective owners.

Prices, product descriptions, images and weekly ad content originate with the retailers and belong to them. Visiting a retailer's own site or app is governed by that retailer's terms and privacy policy, not by ours.

Acceptable use

Use Cartworth to shop. Do not:

Use it to build a competing commercial price database, or systematically extract and redistribute its output at scale.
Automate it beyond ordinary personal use, or attempt to evade rate limits, technical protections or the free tier limits.
Reverse engineer, decompile or modify the app except where the law expressly says you may.
Use it to break the law, or to interfere with the operation of Cartworth or any retailer's site.
Misrepresent Cartworth's output as a guaranteed price, or as an endorsement by any retailer.

Ownership

Cartworth, including the app, the website, its design, its text and the way it matches and normalises prices, belongs to us. You get a personal, non-exclusive, non-transferable, revocable license to use it for your own shopping, on devices you own or control. Nothing else is granted.

App Store terms

These clauses apply to the Cartworth iPhone app because it is distributed through Apple's App Store:

This agreement is between you and us only. Apple is not a party to it.
We, not Apple, are solely responsible for the app and its content.
Apple has no obligation to provide any maintenance or support for the app.
If the app fails to conform to any applicable warranty, you may notify Apple and Apple will refund the purchase price. To the maximum extent permitted by law, Apple has no other warranty obligation of any kind with respect to the app.
We, not Apple, are responsible for addressing any claim relating to the app, including product liability claims, claims that the app fails to conform to a legal or regulatory requirement, and claims under consumer protection or similar law.
We, not Apple, are responsible for the investigation, defence, settlement and discharge of any third-party claim that the app infringes intellectual property rights.
You confirm that you are not located in a country subject to a US Government embargo or designated as a "terrorist supporting" country, and that you are not on any US Government list of prohibited or restricted parties.
Your use of the app must comply with any applicable third-party terms of service, including the Apple Media Services Terms and Conditions.
Apple and Apple's subsidiaries are third-party beneficiaries of this agreement and may enforce it against you.

Disclaimers and limits on liability

Cartworth is provided "as is" and "as available". To the fullest extent permitted by law we disclaim all warranties, express or implied, including any implied warranties of merchantability, fitness for a particular purpose, non-infringement, and any warranty that prices or other information are accurate, current, complete or uninterrupted.

To the fullest extent permitted by law, we are not liable for any indirect, incidental, special, consequential or punitive damages, or for lost savings, lost time, wasted journeys, or any difference between a price shown in Cartworth and a price charged by a retailer. Our total liability arising out of or relating to Cartworth is limited to the greater of the amount you paid us for Cartworth in the twelve months before the claim, or twenty five US dollars.

Some jurisdictions do not allow the exclusion of certain warranties or the limitation of certain damages. Where that is the case, the exclusions and limits above apply only to the extent that jurisdiction permits, and nothing here limits liability for fraud, for death or personal injury caused by negligence, or for anything else that cannot lawfully be limited. You may have consumer rights that these terms cannot override.

Changes, suspension and termination

We may change, add or remove features, and we may change these terms. When these terms change, the date at the top of this page changes. If a change materially reduces what a paid plan includes, we will say so clearly rather than burying it. Continuing to use Cartworth after a change means you accept it; if you do not, stop using Cartworth and, for a subscription, cancel it.

Retailers control their own websites. If a retailer stops publishing prices in a way Cartworth can read, or blocks automated access, that store's prices may stop appearing. We will show why rather than quietly dropping it, but we cannot promise any particular store will always be covered.

You can stop using Cartworth at any time by deleting the app or closing the tab. We may suspend or end access for anyone who breaks the acceptable use rules above.

Governing law

These terms are governed by the laws of the State of Illinois, without regard to its conflict of law rules, and the state and federal courts located there have exclusive jurisdiction, except where the law where you live gives you the right to bring a claim in your own local courts.
